Call about an assault led to arrest

On Oct. 23 at around 1:08 a.m. Dep. Aldo Aguilar of Weakley County Sheriff’s Department responded to a call regarding a female being physically assaulted in her vehicle on the way to 1059 Old Latham Road in Dresden.

On his way to the residence Dep. James Sanders informed him that a James Smith lived at the residence and had threatened to harm law enforcement in the past and did have firearms.

As Aguilar approached the residence he observed a white male with no shirt on walking towards his direction with one hand behind his back. Aguilar then proceeded to give loud verbal commands for him to show both of his hands and to get on his knees due to the fact that he might be Smith.

At that time, Dep. Sanders arrived on the scene and helped Aguilar detain and safely disarm him. After securing the firearm, the man was identified as Smith and informed officers that his wife had picked him up from a bar on Paris Highway 54 because he had been drinking and was bringing him home. Smith said they began to argue and he got out of the vehicle.

Other deputies on the scene spoke to Smith’s wife, Tiffany Smith, and she informed them that he had actually jumped out of the vehicle and walked towards the house. Aguilar did observe multiple cuts to Smith’s body but was never able to get a clear answer as to how he was injured.

Smith declined to be seen by EMS and his wife declined to press charges. Aguilar then asked Smith how much he had to drink and he advised him that he had a lot throughout the day, but most recently he had three Coronas at the bar before being picked up.

Aguilar had Smith perform a series of standardized tests and he performed at a level that Aguilar believed to pose a danger to himself and the public with a loaded firearm.

Smith was charged with public intoxication and possession of a weapon under the influence.
